User Agreement
1. General Provisions
1.1. This User Agreement (hereinafter referred to as the “Agreement”) constitutes a public offer of the Company and defines the terms of use of the website, governing the relationship between the user of the website (hereinafter referred to as the “User”) and "Ontustik Terminal" LLP (hereinafter referred to as the “Company”) in connection with the use of the Company’s website (hereinafter referred to as the “Website”).
1.2. By using the Website, including browsing pages, completing forms, submitting applications, registering a personal account, uploading documents, or otherwise using the Website, the User confirms that they have read, understood, and fully accepted the terms of this Agreement and undertake to comply with the provisions hereof.
1.3. In the event that the User disagrees with the terms of this Agreement, the User must immediately cease using the Website.
1.4. The Company shall have the right to amend the terms of this Agreement unilaterally without prior notice to Users. The current version of the Agreement shall always be available on the Website. The User is obliged to independently monitor any amendments to the Agreement.

2. Rights and Obligations of the Parties
2.1. The User shall be obliged to:
2.1.1. Comply with the terms of this Agreement and applicable legislation.
2.1.2. Refrain from taking any actions aimed at causing damage to the Company or interfering with the operation of the Website.
2.1.3. Provide only accurate and truthful information when completing forms on the Website.
2.1.4. Use the Website only by lawful means and methods.
2.1.5. Refrain from taking any actions that may disrupt the operation of the Website.
2.1.6. Not post or distribute through the Website any information that violates the legislation of the Republic of Kazakhstan, contains insults, threats, defamatory statements, obscene language, infringes upon the rights of third parties, contains malicious software or links thereto, or constitutes spam.
2.2. The User shall have the right to:
2.2.1. Contact the Company’s support service regarding matters related to the use of the Website.
2.2.2. Use the functionality of the Website within the limits established by this Agreement.
2.3. The Company shall be obliged to:
2.3.1. Ensure that the User is able to access the services and information provided on the Website, provided that the User complies with the terms of this Agreement.
2.3.2. Process Users’ personal data in accordance with personal data protection legislation.
2.4. The Company shall have the right to:
2.4.1. Process Users’ personal data provided during the use of the Website.
2.4.2. Make changes to the functionality and content of the Website without prior notice to Users.
2.4.3. Modify the structure, content, functionality, and design of the Website without prior notice.
2.4.4. Temporarily restrict the operation of the Website for the purpose of carrying out technical maintenance and related works;
2.4.5. Restrict or block the User’s access to the Website, in whole or in part, in the following cases:
– violation by the User of this Agreement;
– detection of attempts of unauthorized access, interference with the operation of the Website, or breaches of security;
– posting by the User of prohibited information.
2.1. The User shall be obliged to:
2.1.1. Comply with the terms of this Agreement and applicable legislation.
2.1.2. Refrain from taking any actions aimed at causing damage to the Company or interfering with the operation of the Website.

3. Liability
3. 3.1. The Company shall not be liable for any direct or indirect damages incurred by the User as a result of the use of or inability to use the Website.
3.2. The Company does not guarantee uninterrupted and error-free operation of the Website, nor the preservation of information posted by the User.

4.2. Prior to initiating legal proceedings, the Parties undertake to make every effort to resolve any dispute through negotiations.
4.3. The period for reviewing a written claim shall be 10 (ten) business days from the date of its receipt.

4.2. Prior to initiating legal proceedings, the Parties undertake to make every effort to resolve any dispute through negotiations.
4.3. The period for reviewing a written claim shall be 10 (ten) business days from the date of its receipt.
5.1. This Agreement shall be governed by and construed in accordance with the applicable legislation. Matters not regulated by this Agreement shall be resolved in accordance with the legislation of the Republic of Kazakhstan.
5.2. All disputes arising in connection with this Agreement shall be subject to resolution by the competent judicial authorities at the location of the Company.
5.3. If one or more provisions of this Agreement are recognized as invalid, such invalidity shall not affect the validity of the remaining provisions of the Agreement.
5.4. Failure by the Company to act in the event of a violation by the User of the terms of this Agreement shall not deprive the Company of the right to protect its interests in the future.
5.5. This Agreement is drafted in Russian, Kazakh, and English and shall enter into force from the moment of its publication on the Website.
5.6. In the event of any discrepancies between the language versions, the Russian version shall prevail.
